Buying real estate is exciting — until you face the bureaucracy involved. In 2026, the process of selling a private house in Ukraine has become more digitalized, but also more strictly regulated. Digital registries, financial monitoring, and wartime regulations must all be taken into account to ensure the transaction does not fail at the notary’s office.

List of Documents Required for Selling a House: 2026 Checklist

Preparing documents is the foundation of a successful transaction. Today, notaries verify sellers through dozens of registries, including debtor databases and sanctions lists. The absence of even one document may stop the process.

Documents Required from the BUYER:

To successfully purchase a house, the buyer must have:

Passport and Tax Identification Number (TIN) — original documents are required. An ID card with proof of residence registration is acceptable. Document sharing through the Diia app is becoming increasingly common, but physical originals are still mandatory.

Spouse’s consent. If the buyer is married, the presence of the second spouse with a passport is required. If the spouse cannot attend personally, a notarized consent statement is needed.

Documents Required from the SELLER (Property Owner):

The seller’s document package is significantly larger:

Title ownership document. This may include a purchase agreement, gift agreement, exchange agreement, inheritance certificate, or court decision.

Important: If your ownership document is an old paper-format document issued before 2013 and has not yet been entered into the electronic State Register of Property Rights, this must be completed before the transaction.

Passports and TINs of all owners. This includes birth certificates of children if they are co-owners.

2026 nuance: For male sellers, the notary may request updated information to verify the absence of restrictions on property disposal.

Technical passport. It must be valid and registered in the Unified State Electronic System in Construction (EDESSB). Old paper technical passports must now be digitized.

Property valuation report. This can be either a certificate from the State Property Fund (generated online free of charge) or a report prepared by a private appraiser. Validity period — 6 months.

Land documents. A cadastral number and extract from the State Land Cadastre are mandatory. Selling a house without the land on which it stands is impossible.

Certificate of registered residents. An extract from the Administrative Service Center (CNAP) or Diia showing who is registered at the property address. Ideally, the house should be legally “vacant” at the time of sale.

Spouse’s consent. If the property was acquired during marriage, it is considered jointly owned property.

Permission from guardianship authorities. Mandatory if a minor child owns even a share of the property.

Selling a House Together with Land: “Two-in-One”

In Ukraine, legally, a house and the land plot are considered two separate real estate objects, even though they are usually sold together.

In 2026, this means that you effectively sign two agreements (or one combined agreement) and receive two separate registry extracts.

Main rule: “No cadastral number — no transaction.”

If your land plot does not have a cadastral number (common with older privatizations), it must be assigned before the sale. This procedure takes time, so it is important to start in advance.

It is also essential to verify the designated land purpose. If the house is located on land intended “for commercial agricultural production,” selling it as a standard residential property may become problematic without changing the land designation.

Important 2026 Nuances

1. Power of Attorney Issued Abroad

Many property owners are currently outside Ukraine. Selling a house through a power of attorney is possible, but there is now a strict requirement:

If the power of attorney was issued abroad more than one month ago (or two months, depending on the country), the notary may require a recent confirmation statement regarding its validity or may even refuse the transaction.

The “freshness” of documents has become critically important.

2. Property Sale Taxes (Updated Rules)

Previously, taxation was fixed. Now, a progressive taxation scale applies to those selling multiple real estate properties within one year.

First sale during the year (ownership over 3 years): 0% tax (tax-free).

Second sale during the year (or ownership under 3 years): 5% personal income tax + 5% military tax.

Third and subsequent sales during the year: 18% personal income tax + 5% military tax.

These rules apply to both apartments and private houses. Be careful if you are selling several properties within the same year.
